III. Data processing operations, categories of personal data and purposes of processing

1. Visit of the Website

Each access to our website inevitably involves the collection of certain, mainly technical information, which, however, may be classified as personal by the courts. This includes the IP address, browser characteristics, date, time and duration of access, consent given (e.g. to the use of tracking cookies).

This information is required to deliver the content of our website correctly and to provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack. We also use the browser characteristics to clarify and correct any errors that occur in the delivery of the website content. Further statistical or scientific eval-uations of this data (e.g. for the optimisation of our internet offer, for market analysis and for the analysis of user behaviour from our website) are only carried out after any personal reference has been removed.

The above personal data will generally be deleted after the end of the browsing session. We plan to keep the above data for analyzation purposes for a period of maximum 90 days and then delete it. The data will only be passed on to our hosting service provider, who manages the web-site on our behalf.

Our right to the aforementioned data processing results from our legitimate interest in operating an internet presence and delivering content in a disruption-free and user-friendly manner and the interest in the use of statistics and scientific research for im-provements, Art. 6 para. 1 sentence 1 lit. f) GDPR. Essential data is processed in order to fulfill our Terms of Use for the Website, Art. 6 para. 1 sentence 1 lit. b) GDPR. With regard to the use of data to provide data to law enforcement authorities, the authorisation is based on the fact that we are obliged to provide information to law enforcement au-thorities in the event of a cyber attack (Art. 6 para. 1 sentence 1 lit. c) GDPR). We are al-so legally obliged to provide proof of the lawfulness of data processing operations (e.g. through consent) (Art. 6 para. 1 sentence 1 lit. c) GDPR).

2. User Account, Contacting, User Postings

You have the option of opening a user account, for example, to create blog posts on our website or to comment on them. You can also contact us via a contact form integrated on the website. In the course of registering and using the user account and contacting us, we process the following categories of personal data:

  • Mandatory master data: Name, first name, e-mail address;
  • Optional master data: Company name, employer, telephone number, address;
  • IP address, as well as date and time of registration, in order to document agree-ment to the contractual terms and conditions and acknowledgement of the data protection declaration.

The data is used exclusively to enable you to use our website (e.g. the comment function) without you always having to provide your data again for this purpose or to communicate with you in contractual matters (e.g. to answer enquiries). If you create or comment on blog posts, this is not done anonymously – as contractually agreed – but by publishing the master data you have entered. The processing of your data mentioned in this section is therefore justified by Art. 6 Para. 1 sentence 1 lit. b) GDPR. You have the option of deleting your customer account and correcting your data at any time.

3. Mailing-list

On our website there is an option to sign up for our Mailing-list. We use the list to inform you regularly about new blogs, comments and interesting posts on our website. For these purposes, we only store and use your email address. During registration, you will receive an e-mail in which you confirm your registration for the Mailing-List again via a link ("Confirm registration" – double opt-in). Registration to Mailing-list can opted-in or opted-out anytime after registration of your account in our Me-page.

In order to manage the Mailing-list and to send the newsletters, we rely on the support of service providers who work on our behalf and on our instructions.

It is possible to unsubscribe from the newsletters at any time by clicking on the unsubscribe link in the newsletter mail. If you unsubscribe or do not complete the subscription process, we will delete your data insofar.

The transmission of data to Google may result in the processing of data by Google and other group companies in the USA - in particular Google LLC, 1600 Amphitheatre Park-way, Mountain View, CA 94043, USA ("Google LLC"). In order to ensure an appropriate level of data protection for data processing by Google, we use EU Standard Contractual Data Protection Clauses (“SCC”) for our contractual relationship with Google, available at: https://business.safety.google/gdpr/. The requirements for technical and contractual data security and data protection measures are regularly updated and reviewed for compliance with applicable data protection law. The responsible party for the data processing of persons living outside the USA is Twitter International Company, One Cumberland Place, Fenian Street, Dublin 2 D02 AX07, Ireland ("Twitter"). When you call up a page of our website that contains such a plugin, which has been activated with your consent, your browser establishes a direct connection to the servers of Twitter. By integrating and activating the plugin, Twitter receives the information that your browser has called up the corresponding page of our website, even if you do not have a profile on Twitter or are not currently logged in to Twitter. LinkedIn thereby receives the information that you have visited this website with your IP address. IV. Transfer of Data

Your personal data will only be transmitted to third parties to the extent necessary for the respective purpose and only if this is necessary for the fulfilment of the contract, on the basis of your enquiry or to comply with our legal obligations. In some cases, this data may also be accessed by service providers that we engage to perform services such as sales and marketing services, contract management, programming and data hosting. We select these service providers carefully, monitor them and ensure that the data is handled with care. We only disclose your personal data to recipients outside the EEA if this is necessary to fulfil the aforementioned purposes or due to your location or access. In this case, we ensure before the transfer that either an adequate level of data protection exists at the recipient (e.g. based on an adequacy decision of the EU Commission for the respective country or the agreement of so-called EU Standard Contractual Clauses) or your consent to the transfer has been obtained.

V. Duration of storage; retention periods

We generally store your data only as long as this is necessary to provide the services of our online offer or we have a legitimate interest in continuing to store it. In all other cases – in particular if you delete your user account or unsubscribe from the Mailing-list – we delete your personal data with the exception of such data that we need to continue to store in order to fulfil legal obligations or for other purposes mentioned in thist privacy statement (e.g. we are obliged to retain documents such as contracts for a certain period of time due to retention periods under tax and commercial law).

Our online offer may contain links to third-party websites. VII. Your Rights

According to the regulations of Art. 15-20 GDPR, you have the right to request information from us about the personal data stored about you. Furthermore, you have the right to request a correction, deletion or restriction of the processing of the personal data stored about you. In addition, you may have the data provided to us transferred in a structured, common and machine-readable format or - if technically feasible - request that the data be transferred to a third party.

With regard to the processing of your personal data on the basis of our legitimate interests, you have the right to object to the processing of your personal data at any time on grounds relating to your personal situation. We will then no longer process the personal data unless we can demonstrate compelling legitimate grounds that outweigh your interests, rights and freedoms, or the processing is for the assertion, exercise or defence of legal claims (Art. 21 DS-GVO).

If you have given us consent to process your data, you can revoke this consent at any time with effect for the future. The lawfulness of the processing of your data until the revocation remains unaffected.

Furthermore, you have the right to lodge a complaint with the supervisory authority if you are of the opinion that the processing of your personal data violates applicable data protection law.
